What are my options?

You must do one of these three things within 30 days of the date on the citation:


1. Pay the fine, admit you are guilty, and receive the appropriate number of points against your license.
2. Elect and attend a driver improvement course (Note: you are only eligible to make this election 5 times in your lifetime and no more than once per 12 months. Also, CDL drivers are not eligible to elect driving school.)
3. Request a hearing and contest the citation. We represent individuals at these hearings and provide them with the following services:
· our attendance may mean it is not necessary for them to attend the hearing at all.
· ensure that laws governing the use of evidence provided by radar and other electronic devises are followed in court.
· ensure that all electronic detection devises were used properly and file appropriate motions for dismissal if they were not used properly.
· file motions requesting that points be withheld from your driver’s license.

How do I retain your office? What is your retainer fee?

To retain our office, submit the following items to our office ( click here for our address, telephone/fax numbers, and office hours ):

1. Client information sheet (which can be downloaded here)
2. The appropriate retainer fee ($199.00 for a single infraction citation in Alachua County that was NOT the result of an accident. If your citation was issued because of an accident or in a county other than Alachua, please see our Fee Schedule.)
3. A photocopy of your driver’s license.
4. The original citation (we recommend that you keep a copy for your records.

What is the difference between a criminal traffic and a traffice infraction?

A traffic infraction is a civil violation such as your basic speeding ticket. You will have 30 days to respond to the citation, and the penalties include a fine and points on your driver’s license.

A criminal traffic charge can be issued in the form of a traffic ticket. HOWEVER, these charges are serious and carry CRIMINAL penalties. In fact, receiving a criminal violation in this way actually CONSTITUTES AN ARREST.

To determine whether a ticket contains a criminal charge rather than a civil infraction, look for these items:
1. A mandatory court date/time on the citation.
2. A checked box that says "Criminal Violation Court Appearance Required."
